Justice Paul Blows the whistle!!!!

“The Bar Association knows he is not a lawyer, but he is protected because he is its tool. Ms Jatou Kah who now works for the UN special court in Sierra Leone, vehemently opposed his admission to The Gambian Bar, because of his questionable credentials but was overwhelmed by other members of the General Legal Council who had a special interest in him for filial and other reasons,.”said Justice Paul.

A seemingly war of words between Lawyer Mai Fatty and his lordship Justic MA Paul is dominating newspaper headlines, with both parties trading charges of misconduct and incompetency against each other. Writing from an undisclosed location, through a third party media contact, Justice Paul dismisses Mai Fatty's recent allegations against him, describing them as “ false and totally unfounded.” The Former President of Gambia’s anti corruption Commission charges that Mai Fatty is not a trained lawyer as he claims. “Mai Fatty appears to have a lot of fire in his stomach. The reason is obvious. The Bar Association knows he is not a lawyer but he is protected because he is its tool. Ms Jatou Kah who now works for the UN special court in Sierra Leone, vehemently opposed his admission to The Gambian Bar, because of his questionable credentials but was overwhelmed by other members of the General Legal Council who had a special interest in him for filial and other reasons,.”said Justice Paul. The former Appeal Court Judge says Fatty was not only involved in shady activities that put his integrity into question while in The Gambia, but was also busy transferring his clients assets into his name. Paul said Fatty could have been debarred if "he was an attorney," in view of the alleged falsification of  his credentials as a lawyer and as well as his attempt to claim Baba Jobe’s assets. “This is obstruction of the course of Justice and a crime. When this reprehensible act came to light   Paul condemned it in the strongest of terms and spared a word or two about it in his considered judgment. Fatty hated this judge with a passion and  we knew it. In other jurisdictions,  Mai Fatty would be prosecuted and sent to jail. And if he is actually a lawyer, he would have been disbarred, we all remembered, how many times he visited the Observer newspaper and shed tears against the paper publishing his criminal activities. In fact, if one would look at The Gambia Bar Association through the prism of Mai Fatty, then the Gambia is in trouble,” Justice Paul argues. I want to seek refuge in the rights and privilege to a rejoinder, in responding to the article by Mai Fatty, following a story on the resignation of Justice Paul from the Gambia Court of Appeal. 

Mai Fatty appears to have a lot of fire in his stomach. The reason is obvious. The Bar Association knows he is not a lawyer but he is protected because he is its tool. Ms Jatou Kah who now works for the UN special court in Sierra Leone, vehemently opposed his admission to The Gambian Bar, because of his questionable credentials but was overwhelmed by other members of the General Legal Council who had a special interest in him for filial and other reasons. His  qualification became an issue when Justice Emmanuel Agim (then DPP of the Gambia) prosecuted a treason matter before Justice Paul with Fatty appearing for the Accused,  Justice Paul acceded to the DPP's request to adjourn the matter until his status was determined in the light of a constitutional provision on the right of a treason defendant counsel. At the time, a case file was being compiled by the police to prosecute him for impersonation. His claim that he trained as a lawyer in a Northern Cyprus University was found to be false. He has never been pleased with  Justice qualification Paul, since then. The moment Landing  Badgie (13 Badgie) was removed as IGP, Fatty got the case file suppressed. He hates Paul’s forthrightness and candor. He believed no Judge would look him in the face and do what Paul did. And everything about him showed he is not a Lawyer. He lacks court manners and ethics. Ever in and out of Police net for one criminal act to another, to a point of being on the run for over a year at some point.  Sincere Lawyers and ordinary Gambians can confirm what I am saying.  

Again, as one of the shadowy lawyers of Baba Jobe during that celebrated trial  which Paul presided, Fatty procured a power of attorney from Baba Jobe with powers to deal with, including disposing of Baba Jobe's assets and money while the case was pending. This was meant to foist a state of helplessness on the state should the state's case against Baba Jobe succeed. No proper lawyer does this, except a criminal. This is obstruction of the course of Justice and a crime. When this reprehensible act came to light   Paul condemned it in the strongest of terms and spared a word or two about it in his considered judgment. Gambia Lawyers threatened to boycott the court presided over by Maduabuchi Paul and did boycott it for some time, and not for four years as claimed, although they were heavily divided as to its propriety. Reason for so-called boycott was initially that they said Paul had threatened to send some of them to prison. That boy- cott did not hold. They threatened again and did make good on their threat during the national conspiracy against this jurist, after the anti-corruption work. It was alleged in a grand conspiracy involving some members of the Bar that Paul committed fraud as legal adviser to AMRC, a position, which he held long before  becoming a Judge. The reason was to raise credibility doubts about his person, in order to discredit the Paul Commission work. It was merely alleged and they said they would boycott  his court. Some lawyers disagreed on the ground, among others, that Barrister Ousainou Darboe was standing trial for murder and no court refused to grant him audience while he was on bail. They reasoned that Paul was neither charged nor tried. The sound minds knew that it was merely a conspiracy containing a pack of lies, only because of his anti-corruption stance, which earn him been elevated to the Court of Appeal following his exoneration and vindication, after thorough investigation.  

All serious- minded lawyers  preferred Paul’s court. They knew it was a court of justice without fear, favour, ill will or affection. Parties in the right loved his court because justice was sure to be done. Serious- minded Lawyers and parties also knew that he disposed of cases expeditiously. He has that as a reputation , he sits in court from morning to close of work at 4pm everyday. I do not know where Fatty got the story of 300 cases from. By the time Paul was elevated to the Appeal court, no judgments were pending with him. I maintain that his cases were hardly the subject of appeals. Fatty knows it.  

A mercenary is somebody who is paid to do a job. As a Judge in The Gambia his earnings were scandalously low.  

Paul was on firm legal ground, when he sent Antouman Gaye to prison and he and they knew it. Lawyers are not above the Law. It is one of the reasons why Fatty and some others cannot forgive Paul It seemed like a demystifying act. Gaye knew  Paul was right and had to pay the money for which he was sent to jail, with accrued interest. They had no choice than to hate his audacity. I Paul is no coward.  

Paul was  never, I repeat never, suspended from the Judiciary. We do not know when, why and how. This is news to all.  

The Paul Commission was not a witch-hunt. It is unfortunate that Fatty has had no access to the Commission's report. 

That he expressed contempt for the Islamic religion is one of the many red herring sought to be used against Paul, during the Commission's sittings but it did not stick because it was not true.

The re-appointment of Yankuba Touray was an executive act for which Paul was not responsible. If anything, he should be given enormous credit for making extensive adverse findings and recommendations against Touray who was one of Jammeh's hench men.

The Commissions findings and recommendations were always with legal basis.  

We do not know about the court of Appeal staying execution on the Commission's recommendations. Mai Fatty  in this regards has spoken.
