   EDITORIAL

For those old enough to remember, what transpired in The Gambia this past week, is reminiscent of the 70s. It was a throw back to an era when monsters ruled, and politically motivated murders were mere games that dictators played. And the media; well, Pravda comes to mind; oh and Gamma too. The Soviet's Pravda and Fidel Castro's Gamma; two among many papers that brought propaganda to a new level of deception, rode a wave of treachery, and became calculated accomplice to unprecedented brutality. That was a time when blatant lies and misinformation ruled, and truth resided in the state; and the state alone.

As if that was not enough, the once mighty Daily Observer, formerly one of Africa's premiere newspapers, has done the unthinkable; work in cohort with a government with a history of extra-judicial executions and murders.

My friend asked me to shun from visiting the Gambia while Jammeh is in power. I called my immediate families, and everyone was scared to death. On March 27, 2006, the Gambia government again swooped down, with sharpened claws, on The Independent newspaper. Its top staff were arbitrarily arrested and detained for over three weeks and its offices were sealed and put under armed guard. On April 10, reporter Lamin Fatty was arrested and detained.Today, two months later, The Independent’s offices remain sealed and under guard and Lamin Fatty remains detained by the secret police, the National Intelligence Agency.

Our dear country is at a sharp turning point. Truth is making triumph over falsehood. Evil shamefully succumbs to good. Those who enjoy the dirty fruits of cheating will no doubt feel offended by the simple mention of their ungracious misconducts. If you prefer not to be mentioned, you may choose not to serve in public office. While in public office, if you dare do whatever you do, the people will dare talk and write about it.It beats sane minds when some people prefer others to keep their views under tight lips and frozen writing fingers while those in charge of public resources and social welfare refuse to behave in the best interest of all.

I am a Gambian, currently residing in the UK. I subscribed as a reader of the online Freedom Newspaper. Pa Nderry Mbai, a US-based Gambian journalist, serves as Managing Editor/Publisher of the paper. On Tuesday 23rd May 2006, I woke up and found only one article entitled “Resume” on its website claiming that Pa Nderry had decided to stop producing the paper. The article went further to list the names and contact details of those who had subscribed to the paper, labelling the subscribers as informants. Sometime later, that article was replaced with another one denying the claims, attributing what had happened to hackers. On Thursday 25th May 2006, The Daily Observer newspaper of The Gambia published the list and contact details of the alleged informants, after which the Gambia Police Force issued a press release on the matter, asking all those whose names featured on the Observer list to report to them with immediate effect or face arrest and prosecution. The aforementioned press release was carried by both the Daily Observer and The Point in their editions of Friday 26th May 2006. The man at the centre of the issue, Pa Nderry ran a rejoinder in the Freedom Newspaper, threatening the Daily Observer with legal measures for disclosing the identities of his subscribers, trying to exculpate the subscribers by contending that they were mere readers, not informants.

Your domestic terrorism has been extended overseas with your recent attempt to close down the Freedom Newspaper. This paper is blessed by God and come what may we are here to stay. Mr. President, you acted stupidly by cracking down on our innocent subscribers, who do not have knowledge about our news content. These subscribers are freedom loving people. They like the Freedom Newspaper. Will you extend your arrest to the United States? The list that was published by the Observer bears the names of American Citizens as well. My own former Voice of America Radio Editor Joe Decapua was classified as one of the “informants” of Pa Nderry M’Bai. Does this makes sense to you? What is your objective? What is wrong with you Mr. President? Are you really okay? Retarded Jammeh needs mental help. You are far from being okay. A ten year old boy will not behave like you.

State house's latest 'verbal memo' from President Jammeh...

Until this evening so far nothing has changed as far as this latest 'verbal memo' is concerned. President Jammeh has categorically said he does not want any calls forwarded to him without them passing through the Secretary General Mambureh Njie. This means he does not even want his confidential secretary to handle that any longer. This is a new phenomenon within the state house culture. My source is part of those who disseminate these memos be they verbal or written ones. Why is President Jammeh saying so? Has he been receiving insulting calls? Is he trying to avoid calls from President Wade? Is he doing so because he feels so insecure talking on the phone? Two days ago so many Gamtel subscribers were taken off line for hours. Some of those customers said they had no outstanding bills to settle.

International customary law from time immemorial has always granted immunity to heads of states, in their capacity as leaders of a nation or a country. With such immunity, a head of state is not liable to face criminal and civil persecutions whilst in office as the leader of a nation. However events in the 21st century, has shown heads of states stripped of immunity and facing International Criminal Courts. Does this portend that immunity to heads of states is shifting or twisting in a different dimension? Can heads of states escape justice after committing gross violations of Human rights under International law? Recent events affirmed that heads of states can no longer enjoy immunity for gross violations of crimes under International Law.

Daily observer has clearly spelt out that they are not professional, they think they are in favour of the government, but they indeed  missed  the strategy, because the president lost confident in them, some of us has been sending mail and publishing with daily observer two years, so we know their stand.
