Gambia: In Darboe And Co Trial, Judge Dismisses Defense’s Application To Retry The Accused Persons


The new judge presiding over the case of the detained Gambian opposition leader Ousainou Darboe, and co, has dismissed an application made by the defense team for the matter to start afresh, following the withdrawal from the case by the Cameroonian born judge, the Freedom Newspaper can reveal. Justice Dada, who withheld the prosecution’s submission that the case should proceed ruled that her court has the legal jurisdiction to proceed from where the former judge stops.

In that, she has all the records of proceedings. Hence, the judge said the defense’s argument that the case should start afresh was untenable. She sided with the prosecution in her ruling.

Justice Dada’s ruling has indeed shocked the defense team. Almost everyone in court was taken aback by the judge’s decision not to entertain the defense’s application. The defense can file an appeal should they find it imperative to challenge’s judge’s decision, said a legal analyst. This is a tricky politically motivated case.

“The Nigerian judge is here to exceed Jammeh’s expectations. Her goal is to secure a conviction against the accused persons. She is going to be compensated for doing a dirty job for the Kanilai monster. Do not be surprised if he gets promoted to the position of Chief Justice, after all is said and done. There is an intensive pressure exerted on her from the State House to ensure that Darboe and co are jailed. That I can tell you,” said an insider at the AG Chambers.

Lawyer Antouman Gaye, Hawa Sisay Sabally and co have offered to represent the accused persons on pro-bono basis. The matter was adjourned to a latter date.
