The verdict of Hon. Ya Kumba Jaiteh Nominated N.A.M. against the state is a demonstration of the Judiciary balancing the fairness challenge (juridical and sociological perspective) that is face by most governments. It means that no one is above the law and that there is independence in the judicial system and so far the most robust organ of the Government.
As I have said before, Hon. Jaiteh’s nomination by the President would not have been possible if she had failed any part of Section 89 of the Gambia 1997 Constitution. Moreover she has not done anything that disqualified her according to section 90.
I am once again calling for the authorities particularly the President to get the correct advice from the competent people when making decisions to avoid embarrassment, however applaud him for respecting the rule of the law at the same time to balance the individual and collective desires of the people.
