The accused Gambia Action Party Leader Musa Batchilly will know his fate on May 4th, 2021, as the magistrate presiding over his case, has adjourned the matter for judgment. Batchilly has been charged with fraud and obtaining money by false pretense; charges he has denied. The prosecution has charged Batchilly for defrauding one Fatoumatta Baye Saine, the sum of 6,000,000 CFA, which is equivalent to D504,000 dalasis. The funds were meant for a Bayokunku landed property that Batchilly falsely claimed to have owned and was sold to Mrs. Saine. The compliant has accused Batchilly of stealing over $12,000 dollars from her. The charges were filed against Batchilly in 2019. He was released on a D500,000 bail.

Earlier on, Batchilly’s lawyer Ebrima Kijera wanted the court to file contempt charges against Mrs. Saine’s brother Modou Baye. He told the court that his client was harassed by Baye in the last adjourned date.  But magistrate Isatou Janneh Njie refused to entertain lawyer Kijera’s request. She overruled it.

As the case had suffered numerous adjournments, with Kejera’s contempt application against Mr. Baye rejected, magistrate Njie then ruled that Kijera’s client should open his defense henceforth. Unhappy with the magistrates’ decision, Kijera dropped the ball and asked magistrate Janneh Njie to proceed and pass judgement on the matter. His request was granted. Judgement has been slated for May 4th.

A frustrated Musa Batchilly could later be heard saying: What have I done to my lawyer? He wants to send me to mile two.”

Superintendent Almameh Manga, who represented the IGP, had earlier opposed Kijera’s request for adjournment.  He said the accused Batchilly had told the court in the last sittings that he was ready to proceed with his defense. Manga then urged the court to reject the defense request for another adjournment. His request was granted.

Batchilly walked out of court angry and confused. His fate would be decided on May 4th.
